Most people treat “blockchain” as a marketing word. Pakistan’s Virtual Assets Act, 2026 treats it as a defined legal term — and the definition is doing real work across the statute. It determines when a technology falls inside the Pakistan Virtual Asset Regulatory Authority’s (“PVARA”) oversight mandate, and it interacts with the definition of a Virtual Asset in a way that pulls some otherwise-regulated instruments into scope.
The definition itself is one sentence. It contains four technical properties, a delivery mechanism, and an express reservation of power to expand it later. Each of those matters if you are preparing a licensing file or a PVARA sandbox application.
This analysis reads section 3(1)(iii) of the Act alongside the provisions that depend on it, and sets out what the definition does and does not settle.
How does Pakistan’s Virtual Assets Act define blockchain?
Section 3(1)(iii) of the Virtual Assets Act, 2026 treats “Blockchain”, “Distributed Ledger Technology” and “DLT” as a single interchangeable defined term. It means a technology enabling a distributed ledger — an information repository recording transactions or data across multiple nodes in a synchronised manner, using cryptography to ensure integrity, tamper-resistance, immutability and consensus among participants.
The operative wording is:
“Blockchain” or “Distributed Ledger Technology” or “DLT” means a technology that enables a distributed ledger, an information repository that records transactions or data across multiple nodes in a synchronized manner using cryptography to ensure integrity, tamper-resistance, immutability, and consensus among participants, as may be further defined by Regulations;
Two structural points follow immediately. First, the Act makes no legal distinction between “blockchain” and “DLT”. Drafters, whitepapers and application forms sometimes use the terms to mean different architectures — a chain of blocks versus a directed acyclic graph, for example. Under Pakistani law, that distinction has no consequence. All three labels point at the same definition.
Second, the definition closes with “as may be further defined by Regulations”. PVARA holds an express power to elaborate. At the time of writing, we are not aware of published regulations refining the term. Until they are issued, the statutory sentence is the whole of the test.
What are the four properties a ledger must have?
The definition requires cryptography to ensure four things: integrity, tamper-resistance, immutability, and consensus among participants. These are cumulative in the drafting — the list is joined by “and”, not “or”. A system that synchronises data across nodes but achieves none of these cryptographically is not, on the face of section 3(1)(iii), DLT.

Alongside those four, the definition contains two further elements that are easy to skip over:
- Multiple nodes. The repository must record across multiple nodes. A single-server database with cryptographic audit logs does not satisfy this limb.
- Synchronised manner. Nodes must be kept in sync. Independent, unreconciled copies would not meet the wording.
Our reading is that “tamper-resistance” and “immutability” overlap substantially, and that the drafter has listed them for completeness rather than to impose two distinct engineering tests. But because the Act lists them separately, a technical description submitted to PVARA should address each by name rather than collapsing them.
Why does the definition matter for licensing and compliance?
The definition matters because it feeds three separate operative provisions: the Virtual Asset definition in section 3(1)(xxxi), PVARA’s blockchain oversight mandate in sections 9(1)(e) and 36, and the technology disclosures required in sandbox and registration applications.
The most consequential link is with the Virtual Asset definition. Section 3(1)(xxxi) defines a Virtual Asset as a digital representation of value that can be digitally traded or transferred and used for payment or investment purposes, and then excludes digital representations of fiat currency, securities or other financial assets regulated under any other law —
except where represented, issued, or transferred using distributed ledger technology.
Read plainly, the exclusion for instruments regulated under other laws falls away where DLT is used. That is a carve-out from a carve-out, and it means the DLT question can decide whether an instrument sits with PVARA at all. Anyone assessing whether a tokenised financial instrument is inside or outside the Act — see our analysis of asset-referenced token issuance under PVARA — has to run the section 3(1)(iii) test first.
That said, the Act does not leave the boundary purely mechanical. Section 2(2)(b) excludes securities, derivatives, collective investment schemes, depositary receipts and other traditional financial instruments falling within the regulatory jurisdiction of the State Bank of Pakistan or the Securities and Exchange Commission of Pakistan. And section 9(1)(f) gives PVARA the power to classify any asset or activity on its substantive features, underlying function, method of use or economic effect, irrespective of nomenclature — subject to consultation with the State Bank of Pakistan or the SECP where the asset exhibits characteristics within their mandates.
In practice, then, tokenising a security does not automatically hand jurisdiction to PVARA in a clean way. There is genuine tension between the DLT proviso in section 3(1)(xxxi) and the exclusion in section 2(2)(b), and it will be resolved by regulation, by the classification power in section 9(1)(f), or by the inter-agency coordination mechanisms contemplated by section 17. We flag it rather than pretend it is settled. If your instrument sits near that line, raise it in your regulatory and licensing workstream early rather than assuming a category.
Does the Act regulate blockchain itself, or only virtual assets?
The Act reaches beyond virtual assets. Section 9(1)(e) makes it a function of the Authority to promote, develop, govern and regulate the adoption, deployment and scalable use of blockchain and distributed ledger technology across Pakistan. Section 36 then makes rulemaking on that adoption mandatory.
Section 36(1) provides that the Authority “shall issue Regulations, standards, directives, and guidelines on the adoption, deployment, and use of blockchain or distributed-ledger technology”, and section 36(2) requires it to consult relevant regulators and ministries to harmonise blockchain adoption across Pakistan.
This is unusual and worth pausing on. Most virtual asset statutes regulate services and instruments; this one also gives the regulator a technology mandate. Section 5(3) reinforces it, vesting the regulation and supervision of virtual assets, virtual asset service providers, tokenisation of real-world assets, and blockchain technology primarily in PVARA, in coordination with other regulators where applicable.
The limits are equally important. Nothing in section 36 makes deploying a blockchain a licensable activity. Licensing under section 18 attaches to the ten categories of Virtual Asset Services in Schedule I — see the ten PVARA licence categories explained — and section 50 prohibits unlicensed provision of those services, not the use of DLT. A logistics firm running a permissioned ledger for shipment tracking is not providing a Virtual Asset Service. It may, in time, fall within standards issued under section 36. That is a very different exposure from licensing.
Mining sits in a related position. Section 37(2) states that pure mining, by itself, does not constitute a Virtual Asset Service requiring a licence, but that mining operations involving customer assets or funds are treated as Virtual Asset Services and require licensing. Section 37(3) allows PVARA to establish a registration or declaration framework for operators exceeding thresholds of scale, energy use or hash rate, as set by Regulations. What must you disclose about your blockchain architecture?
Applications require a described architecture, not a label. The PVARA Sandbox Guidelines 2026 require, under Form I Section A, a description of the DLT used — whether public or permissioned — the smart contract platform, wallet architecture, throughput and scalability, in bullet points or table form, with attachments.
The Sandbox Guidelines are explicit that the technology description carries evaluative weight. Form I Section F lists “Strength of Technology and Cybersecurity Measures” among the assessment criteria, and the submission checklist in Form I requires a “Blockchain / DLT architecture description” as a discrete deliverable alongside a cybersecurity plan covering threat model, mitigation and audits.
The self-assessment checklist at Annexure-A of the Sandbox Guidelines sets out the positive and negative indicators under “Technology & Security”:
Robust IT infrastructure, cybersecurity safeguards, smart contract audits, disaster recovery plans. Independent third-party security testing performed.
against:
Weak cybersecurity indicators, no audits, or reliance on unverified smart contracts. Lack of safeguards to ensure custody of consumer’s funds in case of cyber intrusions.
The No Objection Certificate Regulations 2025 approach the same ground from the AML side. Form A1 Section 6.1 requires a high-level description of the technology environment, including core systems supporting onboarding, trading, custody, transfers and recordkeeping, the location of primary and backup data centres, and any use of cloud services with jurisdictional detail. Section 6.2 requires the applicant to list AML-relevant systems, expressly including blockchain analytics. Section 6.3 asks whether those systems are fully operational, in testing, or under implementation.
Practical drafting points for either route:
- State the ledger type. Public, permissioned or hybrid, and name it. Do not write “blockchain-based” and stop.
- Address the four statutory properties. Explain how your architecture delivers integrity, tamper-resistance, immutability and consensus. Use the Act’s own words.
- Separate your chain from your stack. The ledger, the smart contract platform, the wallet architecture and the analytics tooling are four different disclosures in Form I.
- Attach the audit. Smart contract audits are a named positive indicator in Annexure-A of the Sandbox Guidelines; their absence is a named negative indicator.
- Locate your data. Section 39 of the Act permits storage or processing outside Pakistan subject to safeguards prescribed by Regulations, and preserves PVARA’s power to require immediate localisation of specific datasets on national security, financial stability, consumer protection or enforcement grounds.
Where cryptographic key handling is involved, section 40(2)(c) of the Act designates private keys, cryptographic credentials and wallet authentication data as sensitive information requiring logical and technical segregation, need-to-know access control, and encryption and key-management protocols in line with internationally recognised standards. That obligation runs alongside the custody standards in section 26, discussed in our note on the PVARA custody licence.
Where does the definition leave gaps?
Three areas remain open on the face of the documents. First, the threshold question of how many nodes constitute “multiple”, and whether a two-node arrangement qualifies. Second, whether a permissioned ledger operated entirely by one group satisfies “consensus among participants”. Third, how the DLT proviso in the Virtual Asset definition sits against the section 2(2)(b) exclusion for SBP- and SECP-regulated instruments.
None of these is answered in the Act, the Sandbox Guidelines or the No Objection Certificate Regulations as published. Section 3(1)(iii) reserves the power to define the term further by Regulations, and section 9(1)(f) supplies a substance-over-form classification power that PVARA can deploy case by case, subject to consultation where another regulator’s mandate is engaged.
For a business at the margin, the practical route is to seek clarity before building. The Act contemplates three routes short of full licensing: the regulatory sandbox under section 35, no-objection statements or no-action communications under section 35(3), and the No-Action Relief described in the Sandbox Guidelines — which the Guidelines are careful to state does not constitute legal immunity and may be withdrawn on written notice.
